OWNERSHIP
The FAST FACTS, and Zenith Design Group, Inc. logos, product names,
software, documentation and other materials, and all copyright rights are
owned by Zenith Design Group, Inc. The software, documentation, and other
materials were developed at private expense by Zenith Design Group, Inc.,
6240 Columbia Road, North Olmsted, Ohio, 44070. Use of this software is
limited to that use described in this End User License Agreement. Any
copyright or trademark notices, product identification marking or
description, or notices of proprietary restrictions may not be removed.
Removal or alteration of the copyright statement without the expressed
written consent of Zenith Design Group, Inc. will result in immediate
annulment of the license without monetary compensation to the license
holder. The terms of the license, including the agreed upon benefits
extended to the license holder, shall be null and void. Any usage of our
product following the annulment of the license shall be considered
illegal. We also reserve the right to pursue appropriate legal actions
against those in violation of the copyright policy, specifically those
whose intent is to misrepresent and falsely claim credit or ownership of
the script by altering the copyright statement which may or may not result
in improper financial gains for those responsible for the violation.
LICENSE GRANT
By opening the sealed diskette packaging and/or using the software from CD
or electronic download, you agree to be bound by the terms and conditions
of this License Agreement. Redistribution or reselling any contents of
this Software, including images, text, and scripts, is strictly forbidden
without the prior written consent of Zenith Design Group, Inc. License is
for a single personal computer (PC)/single user. If you do not agree with
the terms of this License Agreement, promptly return the software,
documentation, or other materials to the place you obtained them for a
full refund. Zenith Design Group, Inc. hereby grants you a non-exclusive,
non-transferable license to use this software product. You may not adapt,
translate, reverse engineer, de-compile, or disassemble the software.
COPYING PROHIBITED
The software and its associated documentation are protected by U.S.
copyright laws and international treaty provisions. Any copyright or
trademark notices, product identification marking or description, or
notices of proprietary restrictions may not be removed. Except for a
single copy of the software made for backup or archival purposes, the
software and its documentation may not be copied or shared. Any other
copying is prohibited.
LIMITED WARRANTY
Zenith Design Group, Inc. warrants for a period of ninety (90) days from
the date of purchase that the magnetic media and/or software is free from
defects in materials and workmanship under normal use and will perform
substantially in accordance with the directions for use. Any defective
item must be returned, shipping prepaid, with proof of date of purchase
such as receipt or invoice, during the warranty period to Zenith Design
Group, Inc., 6240 Columbia Road, North Olmsted, Ohio, 44070. The defective
item must be received by Zenith Design Group, Inc. no later than thirty
(30) days after the end of the warranty period.
ZENITH DESIGN GROUP, INC. MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED OF
ANY KIND OR NATURE WHATSOEVER INCLUDING, WITHOUT LIMITATION, WARRANTIES OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS LIMITED WARRANTY
GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, BECAUSE SOME
JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED
WARRANTIES.
BREACH OF AGREEMENT - TERMINATION
Any breach of one or more of the provisions of this License Agreement
shall result in immediate termination of the License. You shall then
immediately discontinue use and return all copies of the software and
documentation to Zenith Design Group, Inc. or supply written notice of
destruction of all copies. All provisions of this License Agreement that
protect the rights of Zenith Design Group, Inc. including but not limited
to maintaining confidentiality, shall survive any termination of the
License.
LIMITATION OF LIABILITY
Zenith Design Group, Inc.'s liability for damages resulting from use of
the software shall not exceed the amount of license fees paid by you to
Zenith Design Group, Inc. under this License Agreement. Zenith Design
Group, Inc. shall not in any case be liable for damages incurred by third
party users of applications that incorporate Zenith Design Group, Inc.'s
software and training material software licensing functions.
ZENITH DESIGN GROUP, INC. SHALL NOT IN ANY CASE BE LIABLE FOR SPECIAL,
INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR OTHER SIMILAR DAMAGES (INCLUDING
WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS
INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS)
ARISING FROM THE USE OR INABILITY TO USE THE SOFTWARE, DOCUMENTATION, OR
OTHER MATERIALS, EVEN IF ZENITH DESIGN GROUP, INC. HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE
EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL DAMAGES, THE ABOVE
LIMITATION MAY NOT APPLY TO YOU.
REFUND POLICY
This product is supplied with a 30-day guarantee that the product does
everything mentioned on this web site (www.firealarm.org) as well as in
the product instruction. If you find a feature mentioned that is not
achievable and technical support cannot resolve the issue, simply contact
us for Return Merchandise instructions and you will receive a full product
refund minus any shipping and handling charges.
MISCELLANEOUS
If you acquired the Software in the United States, this license is
governed by the laws of the state of Ohio. If you acquired the Software
outside of the United States, then local laws may apply. Should you have
